UK has formally exited from the Unitary Patent System

July 20,2020, following the formal exit from the EU, the UK took a final step to exit from the European Unified Patent Court and the formal Notice of Withdraw of Ratification of Agreement was handed over to the Secretariat of the Council.

After Brexit, the UK is no longer a part of the European Unified Patent Court system, and its continued participation in courts governed by the EU law would conflict with the British government's goal of becoming a fully independent country.

The European Unified Patent Court Agreement is not yet in force. In Germany, meanwhile, ratifying European Unified Patent Court is considered unconstitutional because the ratification vote did not get the required majority.

The drafting of European Unified Patent Court system is based on Britain as a part of the system, for example, setting up a special medical court in London. In the event of the Brexit, there are other issues should be considered besides the central sector, as to whether the European Unitary Patent System can go ahead.

On February 19, 2013, 25 EU member states signed the Agreement on the European Unified Patent Court in Brussels and decided to establish the European Unified Patent Court.
